$94.5 Million Settlement in Class Action Environmental Contamination Lawsuit

NAPERVILLE, IL—After three years of litigation, the Honorable Stephen E. Balogh, Associate Judge of the 17th Judicial Circuit in Winnebago County, Illinois granted final approval of a $94.5 Million Dollar settlement for damages arising from a massive fire and explosion at the Chemtool manufacturing plant in Rockton, Illinois. The fire created a toxic plume of smoke and dust that lead to the evacuation of homeowners, residents and businesses within a mile of the plant and a shelter in place order for people within three miles of the plant. The settlement is believed to be a record for an environmental class action caused by a smoke plume. The class plaintiffs were represented by Collins Law Firm.

Clifford Law Obtains Highest Verdict in Illinois Against Plastic Surgeon

CHICAGO, IL—Bradley M. Cosgrove and Craig J. Squillace, partners at Clifford Law Offices, obtained a record $66 million judgment on behalf of a 39-year-old mother of four who bled to death following a negligent surgical procedure that went unnoticed. The jury returned a $56 million verdict, the highest verdict or settlement against a plastic surgeon in the state of Illinois, according to the Jury Verdict Reporter. With post judgment interest, the court entered the judgment for $66.262 million.

A three-man-nine-woman jury deliberated three hours Friday afternoon (Dec. 20, 2024) in the case of a Chicago plastic surgeon, Dr. Ayoub Sayeg, and his medical practices that negligently treated Idalia Corcoles who had come to his clinic in November 2019 for liposuction and what is commonly known as a “tummy tuck.” Dr. Sayeg testified he never saw the patient post-op despite Corcoles bleeding internally for hours that resulted in her suffering a cardiac arrest and ultimately dying. Dr. Sayeg has been sued for medical malpractice in other cases in the past.

The trial of one week was held before Cook County Circuit Court Judge John H. Ehrlich at the Daley Center.

Corcoles underwent the surgery on Nov. 23, 2019. She was in surgery for four hours that ended about 9 a.m. before being sent to post-op where only a nurse was overlooking her recovery. Despite warning signs of lowering blood pressure and abnormal breathing, Dr. Sayeg never came to check on this patient and instead moved on to the next surgery despite her deteriorating condition.

By approximately 1:45 p.m. that day, an ambulance was called to take Corcoles from Dr. Sayeg’s office to Advocate Christ Hospital where despite live-saving efforts including massive blood transfusions and surgery, she died the next day. It was found that the internal bleeding in her abdomen amounted to more than half the blood in her body.

The foreclosure stemmed from discriminatory practices, including the city’s repeated denial of the Church’s exempt status for sewer taxes and subsequent liens on its property for unpaid assessments. The liens were then sold to a private institution, which foreclosed on the Church. These actions align with a troubling pattern of targeting minority-occupied neighborhoods, raising questions about the fairness and equity of the city’s practices.

SYRACUSE, NY—Barclay Damon environmental attorneys assisted BNSF Railway with the submission of an amicus curiae brief to the US Supreme Court as the court grappled with questions about the extent to which an agency must consider the upstream and downstream effects of approving energy and transportation infrastructure projects. The brief was presented by the Association of American Railroads (AAR) in a pivotal case involving the National Environmental Policy Act (NEPA).

BOSTON, MA—MG+M The Law Firm Partners John Hugo and Joe Bussiere successfully secured the dismissal of all claims with prejudice for their client PFS Corp.—a third party inspection agency—following a 15-day trial in Massachusetts Superior Court (William Christina and Catherine Christina vs. PFS Corporation d/b/a PFS TECO et al., Superior Court C.A. No. 1877CV00506). The judge issued her formal order to dismiss on November 26, 2024.

The case, filed in 2018, involved more than 10 defendants and 30 claims. John and Joe moved for a directed verdict along with a request for involuntary dismissal after the plaintiffs rested before the jury. In addition to highlighting the lack of evidence supporting the claims against their client, John and Joe sought involuntary dismissal by presenting clear evidence of misrepresentations made throughout the trial by the plaintiffs and their structural engineering expert. They also exposed the plaintiffs’ bad faith discovery practices, including withholding key evidence of destructive investigation into the building’s structure.

The court allowed their motion and those of all other defendants in the case effectively dismissing the case prior to the presentation of any evidence by the remaining defendants. The result was the culmination of an effective joint effort amongst the defendants in vigorously litigating pre-trial disclosures, expert disclosures and multiple motions in limine that eroded the plaintiffs seven-figure claim.
