Sacks Tierney Negotiates Landmark $5B Arizona Water Rights Settlement Resolving the Navajo Nation’s 60-Year Legal Battle

SCOTTSDALE, AZ—Sacks Tierney P.A., an Arizona-based business law firm, has played a crucial role in leading the Navajo Nation through the final negotiations of a historic settlement that will make clean drinking water available to thousands of people for the first time. The $5 billion Northeastern Arizona Indian Water Rights Settlement Act of 2024 will resolve the state’s most significant outstanding water claims after 60 years of disputes, making it the largest Indian water rights settlement in the country.

The Navajo Nation, the Hopi Tribe, and the San Juan Southern Paiute Tribe signed the agreement on July 17, bringing the three tribes one step closer to securing federal legislation that will authorize federal funding for water infrastructure on their sovereign territories. The settlement is a landmark agreement between the three tribes, the U.S. government, the state, municipalities, and other non-tribal water users over water rights claims in Arizona, including the Colorado River.

Sacks Tierney’s Indian Law and Tribal Relations practice group leader Judith Dworkin has represented the Navajo Nation throughout six years of litigation, leading to settlement negotiations alongside a team of the Tribe’s own attorneys.

If approved by Congress, a new pipeline will provide safe and reliable water to Navajo lands in Arizona for the first time and expand the amount of water available to the three tribal communities. The legislation would also allow the Navajo Nation to lease its water rights under certain conditions and end a longstanding dispute with the San Juan Southern Paiute Tribe by establishing a reservation on small portions of Navajo land in Arizona and Utah.

All three tribes have agreed to release the state and federal government from state water rights claims and end longstanding litigation. The U.S. House of Representatives will review the agreement at a July 23 hearing, and it is expected to come before the Senate in September.

Medical Malpractice Case Results in $2.05 Million Verdict & Changes Minnesota Law

MINNEAPOLIS, MN—A jury in Duluth has awarded a $2.05 million verdict in a medical malpractice lawsuit. This case, tried by Mike Lammers and his team at Heimerl & Lammers in collaboration with Ashwin Madia’s team at Madia Law, marks a significant victory for patients’ rights in Minnesota.

The case revolves around Joel Meyer, who suffered severe complications when a surgical team at Essentia – St. Mary’s left a laparotomy sponge inside him during a procedure in July 2021. This error led to a severe infection and complications in Joel’s cancer treatment, as well as loss of companionship for his wife, Heather. Initially, St. Mary’s refused to accept responsibility, prompting Joel and Heather to seek legal assistance. However, they faced a significant hurdle: at the time, Minnesota was the only state without a “survivorship” law. This meant that if a person with a valid injury claim died before their trial, their claim would die with them. Given Joel’s stage 4 cancer diagnosis, many attorneys were reluctant to take on the case.

The tide turned when Joel and Heather met Mike Lammers. Recognizing the injustice of the situation, Lammers and his team took on not just the case, but also the challenge of changing the law itself. Heather bravely testified before legislative committees in both the Minnesota House and Senate, advocating for change. Their efforts paid off in July 2023 when Minnesota finally passed a survivorship law (573.01 Survival of Causes), allowing terminal patients and their families access to justice. With this legal hurdle overcome, the team pressed forward with the litigation, facing continued defenses, denials, and delays from the hospital. The defense went so far as to blame Joel for his symptoms and even denied that they were negligent in leaving a sponge. 

In November, the hospital offered a settlement of $175,000 – an amount that failed to reflect the severity of the negligence and its impact on Joel and Heather’s lives. Undeterred, the legal team pushed forward to trial. On July 3, 2024, almost three years after the hospital’s negligence, justice was finally served. The jury returned a verdict of $2.05 million for the Meyers – more than ten times the amount of the only settlement offer made.

IADC’s DCJ Offers Comprehensive Circuit Guide On Expert Testimony Admissibility Under New Federal Rule of Evidence 702

CHICAGO, ILAs a comprehensive, circuit-by-circuit guide for lawyers dealing with the issue of the admissibility of expert testimony, the International Association of Defense Counsel (IADC) has focused the entire summer 2024 issue of its prestigious Defense Counsel Journal (DCJ) on federal court decisions no longer authoritative in light of the revisions to Rule 702 of the Federal Rules of Evidence. Amended in December 2023 for the first time in 23 years, Rule 702 governs the admissibility of expert testimony. The purpose of the amendment was to address what the Advisory Committee on Evidence Rules identified as a pervasive problem of “wayward caselaw” in which federal courts had been “far more lenient about admitting expert testimony than any reasonable reading of the Rule would allow.”
