Stites & Harbison Expands Intellectual Property Practice With Addition of New Attorneys and Patent Agents

CHARLOTTE, NC—As the prevalence of imported knock-off products continues to rise on Amazon and other e-commerce platforms, Shumaker’s Intellectual Property team successfully represented Charlotte-based Power Probe in a major infringement case, securing a victory against UK-based Toolsmart Limited. Power Probe, a leader in the automotive industry, safeguards its intellectual property through utility patents, design patents, trademarks, and copyrights. Power Probe’s flagship product, the Power Probe 3, was copied abroad, marketed as the PP7, and then sold by Toolsmart Limited on Amazon in the United States. The infringing PP7 not only replicated the functionality and the appearance of Power Probe 3 device but also copied Power Probe’s product manual.

The Federal Litigation involved claims of infringement of the Power Probe 3 device, which Toolsmart offered for sale on Amazon. The infringing product included copies of Power Probe’s copyrighted product manual, patented functionality, and, perhaps most critically, copies of Power Probe’s protected trade dress. The trade dress infringement included the use of Power Probe’s signature color – Power Probe Red – and the Power Probe 3’s iconic shape.

After identifying the infringement, Shumaker led legal action, resulting in Toolsmart Limited agreeing to a consent judgment for patent, trademark, and copyright infringement. A permanent injunction was issued, removing the PP7 from sale in the United States. The United States District Court for the Western District of North Carolina entered the final judgment and permanent injunction in favor of Power Probe.

Hunt Oil Settles Car Crash Lawsuit for $30 Million

DALLAS, TX—Dallas-based Hunt Oil Company has agreed to pay $30 million to a Texas woman who was left with a permanent and painful back injury after her car was hit by a worker driving a Hunt Oil pickup truck.

The wreck happened on a Friday night in November 2019 in Odessa, Texas. As 53-year-old Barbara Dalby drove her car on State Highway 191, a Ford F-150 owned and operated by Hunt Oil, and driven by a Hunt Oil employee, hit her car head on. As a result, Ms. Dalby, a mother of three, required lumbar fusion surgery and continues to suffer from chronic pain.

Attorneys believe the settlement amount is the highest ever in Dallas County in this type of injury case. The case settled just as jury selection began yesterday in a Dallas County District courtroom. Both Mr. Goudarzi and Ms. Aldous believe that this settlement would not have happened without Dallas citizens showing up for jury duty, ready to serve.

Evidence in the case showed that, at the time of the crash, the Hunt Oil employee who was driving the pickup truck had drugs and alcohol in his system. Evidence in the case further showed that the driver had been doing drugs and drinking alcohol with his Hunt Oil supervisor, immediately before the wreck. Prior to the crash, Ms. Dalby worked as a proposal specialist for a company that helped law enforcement and military organizations, but since the wreck she has been unable to work.

The case is Barbara Dalby v. Hunt Oil Company and Mikeal Crosson, Cause No. DC-21-11344 in the 116th Judicial District Court in Dallas County, Texas.
