CaseyGerry Files Lawsuit in LA Superior Court Against Southern California Edison and Edison International

LOS ANGELES, CACaseyGerry, representing plaintiffs Isabel Gomes and William Armstrong, has filed a lawsuit in Los Angeles Superior Court against Southern California Edison and its parent company, Edison International (collectively “SCE”), for losses arising from the destruction of the couple’s Altadena rental property as a result of the devastating 14,000-acre Eaton Fire in Altadena, California on January 7, 2025.

According to lead attorney on the case David S. Casey, Jr., defendant SCE operates high voltage power lines hanging above Eaton Canyon, an open space preserve within the communities of Altadena, Kinneloa Mesa, City of Pasadena and other adjacent areas of Los Angeles County. “Our client alleges that the defendant operated its electricity infrastructure irresponsibly in unsafe conditions. Eyewitnesses saw the defendant’s power lines sparking above Eaton Canyon – allegedly fueling the massive wildfire which destroyed our client’s rental home and all their possessions, including vehicles, collectibles and more,” he said. “The plaintiffs also allege that SCE didn’t adequately clear parched vegetation away from its utility equipment, exposing the ultra-dry Eaton Canyon to increased fire danger from malfunctioning utility equipment.”
 
When the fire started, the region was under a red flag advisory – a “particularly dangerous situation” fire weather warning – since forecasters had predicted critically low humidity and fierce Santa Ana winds of up to 100 mph. The suit alleges that the utility should have known of this critical situation based on forecasts of potentially catastrophic Santa Ana winds several days before the fire ravaged parts of Los Angeles.
 
According to the complaint, despite the obvious risks and warnings, the defendant allegedly made the decision to continue operations of its electricity grid at Eaton Canyon, resulting in disastrous consequences. “We believe these wildfires could have been mitigated and are focused on holding SEC accountable while seeking justice for our clients, who lost their residence, livelihood and possessions,” Casey said.

Garnett Patterson Injury Law Firm Files Lawsuit Against Huntsville Reproductive Medicine

Adding to this stress, the clinic’s Doctor has announced the closure of the facility and accepted a position elsewhere, leaving patients without recourse or refunds. Completing the procedure elsewhere will cost the client more than $10,000.
 
While the client is currently the only client represented in this lawsuit, Garnett Patterson Law Firm suspects there are dozens of other victims who have been similarly affected by the clinic’s actions.
 
This is a pro bono case, reflecting the firm’s commitment to the community and clients.
 
The lawsuit seeks to recover the funds paid for the IVF treatments and additional damages for the emotional and financial strain caused by the clinic’s actions. Garnett Patterson is committed to ensuring the rights of their clients are protected.

Chad Baruch Wins Appeal for Dallas County Officials in Budget Dispute

February 14, 2025

DALLAS, TX—The Texas 5th Court of Appeals has ruled in favor of the Dallas County Commissioners Court in a lawsuit brought by the Dallas County Juvenile Board that challenged commissioners’ control of the county budget.

The case arose from the Commissioners Court’s request for treatment records related to juvenile detainees following allegations that children were being confined in cells for up to 23 hours a day. Commissioners refused to approve the Juvenile Board’s budget and salary increases until the requested records were provided, prompting the Juvenile Board to file suit in state district court. The Commissioners Court filed a procedural motion challenging the district court’s jurisdiction to hear the case, which was denied, and appealed that decision to the 5th Court of Appeals.

On appeal, Mr. Baruch argued that the Commissioners Court acted within its authority, emphasizing that the lower court’s ruling improperly considered political motives outside its jurisdiction. The Court of Appeals dismissed claims that the Commissioners Court violated the Texas Open Meetings Act and rejected the Juvenile Board’s attempt to seek retroactive salary payments.

In addition, the ruling upheld the trial court’s dismissal of subsequent claims against Judge Jenkins and Commissioners Garcia and Sommerman.

NJ Legal Groups & Harvard Secure Injunction Halting Policy Blocking Detained Noncitizens from Courts

PHILIPSBURG, PA— Judge Stephanie L. Haines of the United States District Court for the Western District of Pennsylvania has granted a preliminary injunction against the U.S. Department of Homeland Security, Immigration and Customs Enforcement (ICE), and various government officials, requiring the defendants to provide individuals detained at the Moshannon Valley Processing Center (MVPC) immediate virtual access to the New Jersey court system.

The ruling will halt a policy that prohibited individuals detained at the remote Pennsylvania detention facility from virtually appearing at criminal court hearings in New Jersey by barring access to Zoom, Microsoft Teams, or the telephone, even though such technology is readily available and routinely used at MVPC for immigration court appearances.

The U.S. District Court recognized that “deprivations [of access to criminal court proceedings] are illegal under the United States Constitution,” and that such deprivations result in “consequential harms.” Noting that “when ICE assumes legal authority over an individual, it includes responsibility for the individual’s rights and protections,” the U.S. District Court ordered the defendants to “immediately function in compliance with the tenants of the United States Constitution” by granting the individuals detained at MVPC access to the courts. This is the first time a court has considered the constitutionality of ICE’s policy denying detained noncitizens virtual access to their state criminal court proceedings. MVPC is one of the largest detention facilities in the country, and there are other facilities that also implement this harmful policy and practice.

As Plaintiff Josefina Doe explained, “this achievement is for all of the women who were with me at Moshannon and who cried because they could not present their cases to the court. And my heart breaks for the women who were already deported, or held for too long, without being heard. I am home today because, due to this lawsuit, I was able to access court for the first time, and the charges against me were dismissed at my first appearance. That allowed me to secure bond and be released. Every single person deserves the same chance.”
