About Atlanta Criminal Defense Law

If you or your loved one is facing a criminal charge, it can be a nerve-wracking and intimidating time.  Given the complexity of criminal laws and the potentially severe consequences, an experienced Atlanta criminal lawyer is essential to navigating through this uncertain time.

Below we have provided some basic information about Atlanta criminal law, including when and how a Atlanta criminal defense attorney in can be most useful.

What Are Criminal Charges?

At its simplest, an individual is facing criminal charges when they have committed a crime.  A crime is any act committed or omitted that violates a public law.  The laws of Georgia will define these forbidden acts.  All crimes will generally fall into one of the following categories:

  • Felony: Felonies are the most severe level of crime, generally punishable by imprisonment for more than a year, in addition to any fines.  Examples of crimes that are considered felonies include murder, arson, and rape.
  • Misdemeanor: Misdemeanors are lesser crimes, generally resulting in prison sentences of less than a year and lesser fines.  Examples of misdemeanors include trespassing and vandalism.
  • Infraction: Infractions are minor or petty crimes that normally do not result in jail time.  Examples include speeding or running a red light.

While each of the above categories of crimes come with different punishments, each can have a significant impact on an individual’s life.

How a Atlanta Criminal Defense Attorney Can Help

If you are facing criminal charges, you should contact a Criminal Defense attorney in Atlanta as soon as possible.  Regardless of whether you have committed some wrongdoing or if you are completely innocent, a licensed legal practitioner will be an invaluable resource throughout the criminal process.

A criminal lawyer in Atlanta can assist in all facets of the criminal process, including:

  • Ensure Your Rights are Protected. You may have heard the recitation of Miranda rights in movies or TV shows – including the right to an attorney.  This is considered an essential right to those facing criminal charges because an attorney can ensure a charged individual receives all the rights they are due under the law.
  • Understand the Legal Process. Criminal attorneys know the ins and outs of the legal process for criminal cases.  They can assist you in any preliminary hearings, ensure your bail is set at a reasonable amount, and confirm that all legal procedures are being properly followed by the police and the prosecutor.
  • Create Defense Strategy. Lawyers who work in Atlanta criminal law have significant experience strategizing the most effective way to handle a case.  This often includes striking deals with the prosecution and securing lesser sentences.
  • Understand Case Precedent. One important tool in a successful criminal case is past case law.  If there are past cases where a similarly situated defendant overcame criminal charges, an attorney can use this to persuade a judge or jury that you should see the same result.

As you or your loved one determines next steps for handling criminal charges, an Atlanta Criminal Defense attorney will be an invaluable asset.  The criminal legal process can present unexpectedly complicated twists and turns, where a wrong step could result in serious limitations on your personal liberty.

I was accused of a criminal act in Federal Court. I contacted Mr. Don Samuel and Amanda Clark-Palmer. They met with me and reviewed my case. They then investigated the charges and kept me abreast of court proceedings as the case was postponed some 6 times. Their defense was very organized. 18 months later they defended me in Federal Court and prevailed. They were superb at cross-examination, defense strategy and their opening and closing arguments were excellent and well-presented.Throughout the investigation and the trial they kept me informed, allowed me to give input into witness selection, expert selection, and exhibits provided at trial. They prevailed and I was unanimously found not guilty of all charges and fully exonerated.I recommend them highly for criminal cases and found them fully professional and approachable. If you are alleged to have committed any crime contact them for excellence in defense of your case.G Moore

Garland, Samuel, and Loeb represented my wife and I in a long and drawn out litigation. John Garland was our primary counsel and did an excellent job. In addition to his primary responsibilities he also went out of his way to be available by phone and email when we had questions and was always completely prepared in court. I highly recommend this law firm.

Attorney Don Samuel and John Garland are my saviors. Not only are they knowledgeable, but they also supported me the way a friend would during my darkest hour, and always helped me analyze the situation and determine the best path to take. My case had a very happy ending after fighting it for four years and it is all thanks to their efforts. I highly recommend them!!

The only lawyers to call in Atlanta if you are in need. I originally went to another attorney and was charged by the hour. Thousands of dollars later and with little help I was left with the choice of taking a bad plea or my lawyer telling me to fire him and find another. After this plea I used John Garland. I was charged and all inclusive up front fee and was able to go back and have the plea modified. Mr. Garland was very upfront about what we should do and what to realistically expect and hope for. Before and after the hearing I needed help with applications for work and graduate schools. Mr. Garland was always prompt in returning messages to help. If you have any legal needs this is the firm you should chose. Plain and simple.
