State of New Jersey Reaches Landmark $2 Billion PFAS Settlement With DuPont

TRENTON, NJ—New Jersey Attorney General Matthew J. Platkin, Department of Environmental Protection Commissioner Shawn LaTourette, and the State of New Jersey have secured a historic settlement with DuPont and related companies valued at over $2 billion. This agreement marks the largest environmental recovery by a single state and ranks among the most significant legal recoveries in U.S. history.

The agreement settles the State’s case against DuPont regarding PFAS (per- and polyfluoroalkyl substances), also known as “forever chemicals,” contamination across the state and addresses PFAS and other contamination at and from four historical DuPont industrial sites: Chambers Works, Parlin, Pompton Lakes Works, and Repauno. DuPont’s decades-long use and discharge of PFAS has polluted drinking water and natural resources throughout New Jersey.

This agreement comes just months after the Kelley Drye team assisted New Jersey secure a $450 million settlement with 3M for PFAS, and one month into the first State case in the country to go to trial for PFAS contamination, remediation, and natural resource damages.

The trial against E.I. du Pont de Nemours and Co. (now known as EIDP, Inc.), The Chemours Company, Corteva, Inc., and DuPont de Nemours, Inc. began in Camden, New Jersey on May 19, 2025, before Chief Judge Renée Marie Bumb, U.S. District Judge for the District of New Jersey. For four weeks, the State tried five combined bench trials on statutory liability claims and defensive issues against the DuPont entities related to PFAS and other contamination discharged from DuPont’s Chambers Works site on the banks of the Delaware River. Prior to the parties reaching a settlement, the Court was set to resume with a sixth bench trial on the State’s fraudulent transfer claims related to DuPont’s 2015 restructuring and a jury trial later this the fall on the State’s common law claims and all damages.

The settlement is valued at more than $2 billion. Foundational to the settlement is the agreement that DuPont is responsible to remediate the Chambers Works, Parlin, Pompton Lakes, and Repauno industrial sites, to address PFAS released from the Chambers Works and Parlin Sites, and to pay all costs and damages called for under the settlement. DuPont operated some of these sites for more than a century, causing massive PFAS and other contamination, and significant injuries to New Jersey’s waters and other natural resources. The remainder of the settling defendants are agreeing to stand behind the remediation and funding obligations of DuPont, ensuring that the polluter pays, not the taxpayers of New Jersey.

Boston Jury Hits Johnson & Johnson with Record $42M Verdict in Asbestos Baby Powder Case

BOSTON, MA—A Boston jury has sided with Paul and Kathryn Lovell in a lawsuit against cosmetic behemoth Johnson & Johnson (NYSE:JNJ) that asserted Mr. Lovell’s mesothelioma was directly caused by the company’s iconic, asbestos-laced baby powder. The jury awarded $42,609,300, making it what lawyers believe to be the largest mesothelioma verdict in Massachusetts history.

During the two-week trial, jurors heard compelling arguments from Dean Omar Branham Shirley attorneys Aaron Chapman and Danny Kraft, who detailed how Johnson & Johnson and its affiliated entities knowingly concealed for decades the health risks associated with their talc products.

The attorneys presented internal documents showing the company’s awareness of asbestos contamination, its failure to adopt safer alternatives and systematic manipulation of scientific testing methods. The jury agreed that the company not only failed to warn consumers, but also actively misled the public and regulators by suppressing test results and spreading false assurances about product safety.

The jury found the company’s actions amounted to negligence and breach of warranty. The Lovell family was also represented by Leslie-Anne Taylor of Thornton Law Firm LLP.

Utah Court Issues Terminating Sanctions in Favor of BKLW Client in Highly Publicized Civil Dispute

SAN CLEMENTE, CA—On July 18, another Utah Court dismissed claims against Bienert Katzman Littrell Williams LLP’s client Timothy Ballard with prejudice.

Plaintiff Celeste Borys sued Mr. Ballard, the founder and former CEO of an anti-child trafficking organization, for alleged sexual misconduct. After a motion brought by BKLW attorneys and an evidentiary hearing, the judge found that Ms. Borys’s theft and her attorneys’ public use of the documents was deliberate and egregious and prejudiced Mr. Ballard.

The Court concluded that only terminating sanctions would appropriately punish Ms. Borys’s behavior and deter others from similar conduct.

In the fall of 2023 five different cases asserting claims against Mr. Ballard were filed in Utah state court. Of these five cases in which BKLW represents Mr. Ballard, three have now been thrown out by different judges at or near the pleadings stage.

Mr. Ballard did not commit any wrongdoing and has won three cases already. He has also filed defamation cases against Ms. Borys and other women who have accused him of sexual misconduct.

Spetsas Buist Files Lawsuit Alleging Inadequate Monitoring at Mental Health Facility Led to Tragic Death

ORLANDO, FL—Spetsas Buist Accident Injury Lawyers, a personal injury and wrongful death law firm based in Orlando, has filed a lawsuit on behalf of the family of a young woman who tragically lost her life after escaping the Pasadena Villa Psychiatric Treatment facility. The facility, now known as Lifeskills Orlando, is a residential mental health facility operated by Renaissance Healthcare Group and Odyssey Behavioral Healthcare. The young woman was living at the facility and receiving residential treatment for mental health conditions at the time of her tragic passing.

According to the lawsuit, the young woman, Taylor Meador, was recognized as a suicide risk while under the care of the facility. In fact, this is why she entered the facility in the first place. In an effort to protect her safety, she was to be placed under routine observation where behavioral health technicians were supposed to check on her regularly and document the check, including her whereabouts at the time, what she was doing, and when the technician performed the check. However, the lawsuit alleges that the facility failed to perform scheduled observations, which resulted in Taylor escaping from the facility without intervention.

The lawsuit alleges that on October 22, 2022, Taylor was left unmonitored for a prolonged period and somehow gained unauthorized and unsupervised access to her cell phone. She then escaped the facility without intervention and used her cell phone to arrange for a rideshare service to pick her up. She arranged to be transported to a parking garage in Orlando, where she ultimately committed suicide.

The lawsuit brought forth by Spetsas Buist Accident Injury Lawyers outlines claims for damages including medical and funeral expenses, loss of income and net accumulations, and the ongoing mental pain and suffering endured by her surviving family members, namely Taylor’s parents.

FORT BEND COUNTY, TX—Foley & Lardner LLP secured more than $2 million in attorneys’ fees and costs for its clients in a case involving issues of first impression under the Texas Uniform Trade Secrets Act (TUTSA). The decision, issued on June 26, 2025, by the Fourteenth Court of Appeals in Houston, reverses a significant trial award and shapes the legal landscape in Texas for trade secret and fiduciary duty claims.

This hard-fought appellate victory builds on Foley’s 2023 success in defeating a $42 million damages claim brought by DistributionNOW (DNOW), a Houston-based supplier of energy and industrial products, against 12 former employees now associated with a competitor.

The chief justice of the Fourteenth Court of Appeals authored a detailed opinion in favor of Foley’s clients. The court ruled that TUTSA preempts conspiracy claims based on the misappropriation of trade secrets and instructed other courts to evaluate preemption under the “compare the facts” or “same conduct” test. The court also agreed with the defendants that the charge submitted to the jury, based on the Texas PJC for fiduciary claims against trustees, was improper in the context of departing managers. The appellate court fully adopted the defendants’ proposed jury instructions for breach of fiduciary duty claims against departing managers in Texas. The decision also expands TUTSA’s preemption of claims based on misappropriation of trade secrets to the Texas Theft Liability Act and breaches of fiduciary duties.

Texas Theft Liability Act requires award of attorneys’ fees as a result of TUTSA preemption. The court further rendered judgment in favor of Foley’s clients, ruling that attorneys’ fees and costs are mandatory under the Texas Theft Liability Act for a prevailing party, even when the case is won on preemption grounds. The case now serves as a roadmap for damages causation standards for future Texas trade secret misappropriation cases.

BOSTON, MA—Morgan, Brown & Joy partner Catherine (Cat) Scott filed an amicus brief on behalf of the Massachusetts Defense Lawyers Association (MassDLA) in connection with Miele v. Foundation Medicine, Inc., a case addressing whether forfeiture clauses tied to non-solicitation agreements are definitively excluded from the jurisdiction of the Massachusetts Noncompetition Agreement Act. In the matter at hand, Foundation Medicine claimed that former employee Susan Miele had violated a non-solicitation agreement and a separation agreement. Subsequently, Foundation Medicine stopped severance payments and demanded repayment pursuant to a forfeiture clause in the separation agreement. Scott, on behalf of MassDLA, filed an amicus brief with the SJC arguing in favor of the plaintiff. The MassDLA argued that Foundation Medicine egregiously misinterpreted the Act, and that adopting the position of the defendant would cast a much wider net over a host of agreements that were never intended by the Legislature to be included in the restrictions of the statute.

Johnston Tobey Baruch Scores Appellate Win in Dispute Tied to Bruce Willis Chartered Jet

DALLAS, TX—In a decision that blends A-list travel and high-dollar contract law, attorney Chad Baruch of Johnston Tobey Baruch secured an appellate win for BMH Air and Evolution Jets in Texas’ Fourth Court of Appeals, in a dispute involving a private jet used to fly actor Bruce Willis. The San Antonio appeals court upheld the bulk of a judgment against Saturn Aviation, the Austin charter company that transported Mr. Willis from Ohio to New York in 2017, ruling Saturn was on the hook for nearly $1 million in repairs and legal fees after the aircraft was grounded by mechanical failure.
