The O'Brien Law Firm Secures $3.1 Million Settlement for Crawford County School District Child Molestation Victim

CRAWFORD COUNTY, MO—O’Brien Law Firm Attorney Grant Boyd fought on behalf of a molested 7-year-old girl, protecting her rights and holding the offender accountable. James Philpot, a 73-year-old convicted sex offender, was hired by the Crawford County R-1 School District as a school bus driver in 2021. On February 5, 2024, he pleaded guilty to child molestation and was sentenced to 15 years in prison.

On behalf of the child sexual abuse survivor, Boyd pursued legal claims against the district. As a result, the district agreed in April 2024 to pay the victim a $3.1 million settlement.

Surveillance cameras captured the assaults, which occurred in April 2023. The video recording showed Philpot had the girl sit on his lap as he drove the bus. He kissed her and put his hands down her pants. There were one or more other children on the bus during each assault.

She suffered physical injuries, emotional distress, and damages from Philpot’s sexual abuse. The victim’s parents noticed their daughter had physical signs of abuse, which led to an investigation. Philpot worked at the school for 19 months and was terminated on May 3, 2023.

This wasn’t Philpot’s first conviction involving sex crimes. He was previously convicted of two separate sex offenses, including assault with intent to rape.

Boyd reviewed information that indicates the school district knew about these convictions. He added that Superintendent Cole Byassee was not the superintendent when Philpot was hired.

Gottlieb Law’s Amy Wilson Wins Precedent-Setting Tenant’s Rights Case

PHOENIX, AZ—A Tempe restaurant owner has won an important tenant’s rights case in which their landlord attempted to lock them out of the business prematurely in order to replace them with a higher-paying tenant.

In the case, Burger Rush AZ, LLC, the gourmet burger restaurant, located on Broadway Road just east of Hardy, filed for a preliminary injunction in Maricopa County Superior Court when its’ landlord locked the owners out of their business when rent was just three days late. Burger Rush, represented by Amy Wilson of Phoenix real estate firm Gottlieb Law, prevailed when the Superior Court Judge overseeing the case ruled that the landlord had acted on an inappropriate assumption and belief that the tenant would not be able to cure any default, and this did not justify locking out the tenant.

After being briefly locked out, Burger Rush reopened and continues to operate.

PHILADELPHIA, PA—On Thursday, June 13, 2024, the William T. Coleman, Jr. Foundation, Inc. honored the legacy of William T. Coleman, Jr., Esq. with the unveiling of a sculpture that is now permanently displayed at the National Constitution Center in Philadelphia, in a hallowed alcove off the main lobby. Zenos Frudakis, an internationally acclaimed sculptor, was commissioned to create the bas-relief. Coleman was a Philadelphia native, born and raised in Germantown. Throughout his career, he was the lead attorney in the Girard College civil rights case, counsel to the creation of the Southeastern Pennsylvania Transportation Authority (SEPTA), and special counsel to the Warren Commission, investigating the assassination of President John F. Kennedy in 1963. He was appointed Secretary of Transportation by President Ford in 1975, becoming one of the first African Americans to serve as a cabinet member. The sculpture stands as the first memorial in Philadelphia to commemorate the distinguished African American Civil Rights attorney and Cabinet Officer.
