Clifford Law Obtains Highest Verdict in Illinois Against Plastic Surgeon

CHICAGO, IL—Bradley M. Cosgrove and Craig J. Squillace, partners at Clifford Law Offices, obtained a record $66 million judgment on behalf of a 39-year-old mother of four who bled to death following a negligent surgical procedure that went unnoticed. The jury returned a $56 million verdict, the highest verdict or settlement against a plastic surgeon in the state of Illinois, according to the Jury Verdict Reporter. With post judgment interest, the court entered the judgment for $66.262 million.

A three-man-nine-woman jury deliberated three hours Friday afternoon (Dec. 20, 2024) in the case of a Chicago plastic surgeon, Dr. Ayoub Sayeg, and his medical practices that negligently treated Idalia Corcoles who had come to his clinic in November 2019 for liposuction and what is commonly known as a “tummy tuck.” Dr. Sayeg testified he never saw the patient post-op despite Corcoles bleeding internally for hours that resulted in her suffering a cardiac arrest and ultimately dying. Dr. Sayeg has been sued for medical malpractice in other cases in the past.

The trial of one week was held before Cook County Circuit Court Judge John H. Ehrlich at the Daley Center.

Corcoles underwent the surgery on Nov. 23, 2019. She was in surgery for four hours that ended about 9 a.m. before being sent to post-op where only a nurse was overlooking her recovery. Despite warning signs of lowering blood pressure and abnormal breathing, Dr. Sayeg never came to check on this patient and instead moved on to the next surgery despite her deteriorating condition.

By approximately 1:45 p.m. that day, an ambulance was called to take Corcoles from Dr. Sayeg’s office to Advocate Christ Hospital where despite live-saving efforts including massive blood transfusions and surgery, she died the next day. It was found that the internal bleeding in her abdomen amounted to more than half the blood in her body.

the motion was granted, the auction was cancelled, and the bank agreed to a new payment
arrangement—representing the best possible outcome for the Church and its congregation. Jacobs P.C.’s swift and strategic legal intervention ensured the Church could continue serving
as a beacon of hope throughout the holiday season.

The foreclosure stemmed from discriminatory practices, including the city’s repeated denial of the Church’s exempt status for sewer taxes and subsequent liens on its property for unpaid assessments. The liens were then sold to a private institution, which foreclosed on the Church. These actions align with a troubling pattern of targeting minority-occupied neighborhoods, raising questions about the fairness and equity of the city’s practices.

SYRACUSE, NY—Barclay Damon environmental attorneys assisted BNSF Railway with the submission of an amicus curiae brief to the US Supreme Court as the court grappled with questions about the extent to which an agency must consider the upstream and downstream effects of approving energy and transportation infrastructure projects. The brief was presented by the Association of American Railroads (AAR) in a pivotal case involving the National Environmental Policy Act (NEPA).

The case, which addresses critical aspects of environmental policy and its impact on the railroad industry, holds significant implications for the future of national infrastructure development and environmental regulation. The brief filed by AAR provided the context and importance of rails’ common carrier obligations as well as being instrumental to the justices’ deliberations as demonstrated by the issue’s prominence during oral argument before the Supreme Court on December 10.

NEPA requires federal agencies to assess the environmental effects of their proposed actions prior to making decisions. The outcome of this case could influence how NEPA is applied to future projects, affecting broad sectors of the economy involved in infrastructure and environmental planning.

BOSTON, MA—MG+M The Law Firm Partners John Hugo and Joe Bussiere successfully secured the dismissal of all claims with prejudice for their client PFS Corp.—a third party inspection agency—following a 15-day trial in Massachusetts Superior Court (William Christina and Catherine Christina vs. PFS Corporation d/b/a PFS TECO et al., Superior Court C.A. No. 1877CV00506). The judge issued her formal order to dismiss on November 26, 2024.

The case, filed in 2018, involved more than 10 defendants and 30 claims. John and Joe moved for a directed verdict along with a request for involuntary dismissal after the plaintiffs rested before the jury. In addition to highlighting the lack of evidence supporting the claims against their client, John and Joe sought involuntary dismissal by presenting clear evidence of misrepresentations made throughout the trial by the plaintiffs and their structural engineering expert. They also exposed the plaintiffs’ bad faith discovery practices, including withholding key evidence of destructive investigation into the building’s structure.

The court allowed their motion and those of all other defendants in the case effectively dismissing the case prior to the presentation of any evidence by the remaining defendants. The result was the culmination of an effective joint effort amongst the defendants in vigorously litigating pre-trial disclosures, expert disclosures and multiple motions in limine that eroded the plaintiffs seven-figure claim.

California Lawyers Association Submits Amicus Letter Supporting Petition Challenging the Constitutionality of California’s Limitation on the Use of Electronic Recordings

SACRAMENTO, CA—California Lawyers Association (CLA) submitted an amicus letter on December 5, 2024, in support of the Petition for Writ of Mandate and/or Prohibition that was filed with the California Supreme Court and is aimed at addressing California’s court reporter shortage by mandating the use of electronic recording when court reporters are not available.

As highlighted in the Petition, filed by the Family Violence Appellate Project (FVAP) and Bay Area Legal Aid, “There is an access to justice crisis in the California courts, an ever-worsening court reporter shortage that deprives litigants of verbatim recordings of civil proceedings.” The Petition seeks an order from the Supreme Court mandating that, for any civil proceeding, a litigant who cannot afford to pay for a private court reporter is entitled to have an official verbatim recording created at no charge, including by electronic recording if a court reporter is not available.

Under current California law, courts are authorized to create official verbatim records using electronic recordings when a court reporter is not available, but only in limited civil cases (cases involving a dispute of $35,000 or less), misdemeanor, or infraction cases. Courts are prohibited from using electronic recordings to create verbatim records in other types of cases. Electronic recordings are regularly used instead of court reporters in federal courts, and most of the other states use electronic recordings in their courts. Therefore, as CLA’s amicus letter notes, “modern audio recording equipment is widely used to create an accurate and inexpensive record of proceedings in virtually every courtroom setting except unlimited civil, family, and probate proceedings in California.”

CLA’s amicus letter provides examples from practicing attorneys of real harm caused to litigants because of the absence of a verbatim record, at both the appellate and trial court levels. CLA emphasized that the “prohibition on electronic recording – even when there is no other way of making a verbatim record – has created a system of injustice throughout the state.” CLA urges the Supreme Court to find that the current statutory limitation on the use of electronic recording is unconstitutional and may not be applied to litigants who cannot afford or otherwise practicably obtain a private court reporter when the court does not provide a court reporter.

Legal Aid Organizations Sue Superior Courts of Contra Costa, Los Angeles, Santa Clara, and San Diego to Protect Constitutional Rights of Low-Income Litigants

OAKLAND, CA—Family Violence Appellate Project, represented by Covington & Burling LLP and Community Legal Aid SoCal, and Bay Area Legal Aid have filed a lawsuit in the California Supreme Court against the Superior Courts of Contra Costa, Los Angeles, Santa Clara, and San Diego Counties to resolve the constitutional crisis caused by the statewide court reporter shortage.

The lawsuit filed today alleges that the courts’ failure to provide a verbatim record (word-for-word record) to low-income litigants violates due process, equal protection, and separation of powers under the California Constitution. Without a verbatim record, it is essentially impossible for litigants to appeal an incorrect decision that may be harmful to them. Currently, litigants are denied equal access to the appellate courts simply because they cannot afford a private court reporter – an average cost of $3,300 per day. In addition, verbatim records are vital to the basic operation of our court system, allowing judges to fairly and efficiently administer justice.

Historically, California courts have relied on court reporters to transcribe a verbatim record of hearings and trials, but for several years, there has been a growing shortage of court reporters. The court reporter shortage has now reached a tipping point: it is estimated that over one million hearings and trials in family, probate, and unlimited civil cases had no verbatim record during the year ending in March 2024. The lawsuit seeks an order from the California Supreme Court mandating that, when a litigant cannot afford a private court reporter, they are entitled to have the proceeding recorded at no charge, including by electronic recording if a court reporter is not available. California courts have the ability to create official verbatim records using electronic recording equipment when no court reporter is available, but a state statute (Government Code section 69957) prohibits this in family, probate, and unlimited civil cases. However, electronic recording is permitted for this purpose in several other kinds of civil cases.
