Brian Stewart & Steven Jensen Taking up the Mantle of Parker + McConkie

Long before Brian Stewart and Steven Jensen assumed leadership, Parker + McConkie had already established itself as a legal beacon for the people of Utah. Founded on a philosophy of compassion and an unwavering commitment to justice, the firm built a reputation not only for its formidable legal prowess but also for its dedication to fostering strong client relationships.

Renowned attorneys Bradley H. Parker and James W. McConkie II founded Parker + McConkie almost a half-century ago with a dual mission – to provide unmatched legal expertise and to ensure that every individual who sought their help was met with genuine empathy and human connection.

This unwavering commitment to justice has led Parker + McConkie’s attorneys to take on high-profile cases, including representing the families of homicide victims Gabby Petito and University of Utah student Zhifan Dong. Their remarkable track record and legal expertise have not gone unnoticed, garnering attention from major national media outlets such as CNN, NBC, Fox News, Forbes, the Los Angeles Times, The New York Times, The Washington Post, ESPN, Rolling Stone, and many others.

Today, these core principles remain the driving force behind Parker + McConkie Personal Injury Lawyers. The firm’s attorneys possess an intricate understanding of the courts and the nuanced application of laws, rules, and procedures, skills they leverage to secure the best possible outcomes for their clients. They advocate fiercely, whether navigating complex procedural challenges or presenting cases before a judge or jury. But beyond legal strategy, they prioritize communication and transparency, ensuring that clients remain informed, empowered, and confident throughout the legal process.

New Owners, Same Values

For Brian C. Stewart, the pursuit of justice isn’t just a profession—it’s deeply personal. As a litigation attorney and managing partner at Parker + McConkie, Personal Injury Lawyers, Stewart channels his passion for protecting the injured into every case he handles. His unwavering dedication stems from a devastating personal loss—his father’s death, caused by defective and dangerous products from companies that prioritized profits over people. This experience ignited his mission to hold negligent parties accountable and safeguard others from preventable harm.

“Something I’ve learned over the years in my practice, connecting with people in bad situations, is how much I appreciate the opportunity to help when they are in these crisis moments,” he says. “We meet people who are experiencing the worst time of their lives, and they are confused and disoriented as to how to proceed or how their life is going to go on. So, it can be incredibly rewarding to be able to sit them down and assure them they are going to get through this, and help them navigate the legal and financial issues so they can focus on their families and getting better.

“When Steve and I took over the firm, we had a clear vision of what we wanted—and what we didn’t,” he explains. “The cornerstone of our mission was to maintain a firm that prioritizes the individual, going as deep as necessary to ensure we do everything possible for each client. No shortcuts. Our firm has always been, and will continue to be, one that dedicates the time and resources needed to explore every possible avenue in pursuit of the best outcomes.”

Perfectly aligned with these principles, long-time partner and co-manager Steven Jensen shares the same unwavering commitment to client-centered advocacy. From the beginning, maintaining a culture driven by client needs has remained paramount. When Jensen and Stewart acquired Parker +
McConkie, their goal was not to reinvent what had been so carefully cultivated over the years but to build upon the firm’s legacy as one of the most trusted and successful legal practices in the state. Rather than making sweeping changes, the partners introduced thoughtful enhancements that complemented and strengthened the foundation already in place.

“We both wanted to create something we could manage and own, giving us the autonomy to make decisions that truly prioritized our clients,” Jensen explains. “At the firm we came from, cases were often settled too quickly in pre-litigation, not always with the client’s best interests in mind. We envisioned a firm that focused on quality over quantity—where putting the client first wasn’t just a slogan, but a guiding principle. Our mission is simple: we demand fairness and are willing to take whatever steps are necessary to fight for our clients, protect their interests, and secure a just outcome.”

Choose Your Battle

At Parker + McConkie, the decision to take on a case is guided by a straightforward yet powerful principle: Can we make a meaningful difference? Whether it’s securing justice for an individual whose life has been upended by tragedy or advocating for accountability that benefits the broader community, the firm approaches each case with a deep sense of purpose. This commitment means they don’t just evaluate the merits of a case; they consider the potential to create lasting change, improve lives, and ensure that those responsible are held accountable. If the answer is yes, the firm dedicates its full resources and relentless advocacy to pursuing justice.

“Client impact is always our top priority, no matter how complex the case or the potential financial outcome,” says Stewart. “Some cases may not lead to substantial monetary awards, but that doesn’t diminish the need for justice. When fairness and accountability are at stake, we are committed to fighting for what’s right.”

“You know, back in 1970 Jim and Brad started this firm with a handshake, there was never a formal contract and they took on issues that a lot of other people shied away from either because they were unpopular or too difficult,” says Jensen. “They believed it was important that the helpless and vulnerable had representation, so that’s the mantra we’ve tried to continue.

“There are a lot of cases you might call ‘low-hanging fruit,’ and we’ll take those as well,” Jensen adds. “Then, there are those cases that may have been turned down by five other lawyers, but we’ll see something there and are willing to represent that person to ensure their voice is heard.”

Parker + McConkie’s attorneys work tirelessly alongside accident reconstruction experts, medical professionals, and other specialized witnesses to uncover critical details that others might miss. They recognize that the outcome of most cases hinges on the discovery phase, where evidence is meticulously gathered and analyzed. To ensure success, the firm approaches every case with a trial-ready mindset, preparing from day one. This proactive strategy allows them to craft compelling defense rebuttals and develop innovative approaches that strengthen their position in court, giving their clients the best possible chance for a favorable outcome.

“The average family doesn’t have the necessary resources to explore all possible avenues,” says Jensen. “We do, and we’re not afraid to extend ourselves or our financial resources to make sure we achieve the best possible outcome for these victims.”

“Making a meaningful impact for our clients is always our top priority, no matter how complex the case or the potential financial outcome,” says Stewart. “Even when a case offers little prospect of a large monetary award, the pursuit of justice remains essential.”

A Personal Connection, Compassionate Advocacy

Something else Stewart and Jensen share is their clear commitment to their clients, one that runs far deeper than professional obligation. These attorneys, along with the entire staff, take the time to genuinely connect with each client and their families, listening closely to their deepest fears and concerns. This empathy and compassion provide a steady source of comfort during a time when their world feels uncertain and overwhelming, offering not just legal guidance but also much-needed reassurance.

“Our first responsibility as lawyers is to be honest with our clients,” Stewart explains. “That means discussing potential pitfalls and possible negative outcomes, rather than offering false reassurance. From the outset, we provide a realistic picture, ensuring clients understand the challenges ahead and empowering them to become true partners in the process.”

In fact, while Stewart obviously enjoys every aspect of his career, he readily acknowledges that what he finds most rewarding are the connections he forms with his clients.

“It’s very rewarding to be able to offer these people who are going through the toughest period of their lives a little glimmer of hope,” Stewart says. “By simply acknowledging what they are going through and demonstrating a sincere interest and compassion for their loss seems to help them move forward. I’d have to say that probably the most rewarding experiences are those involving children. So often these little ones suffer injuries that they’ll have to deal with for their entire life. Getting them a good result can be the difference between a lifetime that’s livable with the necessary resources and help they need or something that’s much more difficult.”

“The culture we strive for is client satisfaction first and foremost,” adds Jensen. “We want to have a caring culture. We are fiduciary so our highest duty is to our clients. It’s not like somebody walking in and buying a widget. Here, it’s our duty to put their interest above our own and be completely transparent regarding our goals, our intentions, what results we receive. That type of culture really begins with the first phone call ensuring that everything we do is in the best interest of the client.”

First Choice for Toughest Cases

Parker + McConkie has stood up to powerful adversaries to secure justice for its clients. The firm’s track record speaks for itself—having obtained the largest wrongful death judgment in Utah history and, in 2020, securing a record-breaking wrongful death settlement against The University of Utah for the tragic death of Lauren McCluskey. In 2023, the firm reached another landmark settlement with The University of Utah following the death of Zhifan Dong and, in that same year, achieved the largest personal injury settlement ever paid by Salt Lake County after the negligent death of an inmate.

Parker + McConkie has also set significant legal precedents. In 2018, the firm prevailed in an appeal against a nursing facility that claimed it was not liable after a nurse’s fatal error in administering narcotics went unreported. Earlier, in 2012, the firm won another pivotal appeal, requiring automobile insurers to provide clear and reasonable explanations of underinsured motorist benefits before obtaining waivers from their policyholders.

Frequently making headlines advocating for the families who have suffered unfathomable loss such as in the instances of Gabby Petito and Amanda Mayne in lawsuits against the City of Moab and Salt Lake City, respectively. In these cases, the firm went up against these agencies for failing to conduct proper lethality assessments, failures that could have prevented Gabby’s death at the hands of her fiancé and Amanda’s death at the hands of her ex-husband. With every case, the firm continues its relentless pursuit of justice, ensuring accountability and driving meaningful change.

“These are situations where people who are supposed to be able to protect, either don’t follow the law or don’t do their job the way they are supposed to,” Stewart explains. “For instance, there’s the case of a girl, about 20 years old who was pulled over for a broken taillight. They took her to jail in Salt Lake and she happened to have a small bag of meth in her bra. She was scared that it would be found so she swallowed the whole thing. They knew she had ingested something and over the next couple of hours she deteriorated until she was unconscious. Instead of calling for emergency help, they just left her on the floor of the cell until she died. She was treated as a criminal, not a real person. Her life somehow became worthless.

“That was one we felt strongly about,” he continues. “We worked toward a settlement with Salt Lake County which was the largest wrongful death settlement they had ever paid.”

Since purchasing Parker + McConkie, both Stewart and Jensen have focused on building on the foundation left by their predecessors. With a reputation for tenacity and diligence they are the first choice for some of the biggest and most well-known cases.

So, what sets this firm apart? According to Stewart it’s their complete commitment to each and every client and the reputation for following through to ensure the best results.
